Child Protection: Challenges and Impediments before Access to Criminal Justice

Abstract

: Access to justice is a fundamental right in itself and has its own intrinsic values for safeguarding and promoting the most cherished norms of human rights. United Nations has reaffirmed the right of equal access to justice for all including the protection of the rights of children i.e. legal protection from discrimination, abuse and exploitation, protection from violence, securing the united nations principle of Best Interests of the child provided under Article 3 of UN Convention on the Rights of the Child. The notion to secure the access to justice for children requires a sensitive justice delivery system along with the effective remedies to claim their rights. In spite of wide ranging legal frameworks available for protection of child rights, the access to justice for children remains a massive challenge due to antiquated functioning system of our legal system.
