Evolution of Basic Structure in Indian Constitution

Abstract

The term basic structure has not been defined by the Constitution of India or by Judge of any case they have dealt with. Basic Structure of Constitution consists of basic elements or features or essential elements of the Constitution which the Indian Parliament con not amend under any circumstances or under Art. 368. Hence, it become necessary that how and why the concept of doctrine of basic structure evolved in India. First time in 1973 in Kesavananda Bharati case1 Supreme Court controlled the Amending power of parliament using this doctrine.
