Decoding Common Law and Civil Law: Origin, Goal and Legal Mechanism

Abstract

Common Law& Civil Law are one of the two paths, heading towards the same goal and objective. Main difference lies in the orientation and the path of development and formulation of both the streams of law.The approach and fundamentals of jury bench and bar is the key significant factor which distinguishes both the streams of law from each other. This paper elaborates about the law-making mechanism of both the Civil Law and the Common Law while also laying down emphasis over the differences, origin, purpose and key distinguishing factors between both the laws.
